These terms govern your use of the Winding Way Labs LLC services, including our iOS applications (Winding Way, Winding Way Stories, All American Roads, NYC Stories, and Travel Buddy) and our websites (including windingway.app, allamericanroads.com, allamericanroads.app, nystories.app, and newyorkstories.app) — collectively, "the Services," provided by Winding Way Labs LLC ("we," "us," "our"). By using the Services, you agree to these terms.
The Apps provide travel planning tools, guidebook content, audio stories, and an AI travel companion. All content — including trip itineraries, stop descriptions, driving directions, tour guide responses, and audio narratives — is generated for informational and entertainment purposes only. Content in the Services does not constitute professional travel advice, safety guidance, or navigation instructions.
You are solely responsible for verifying all travel conditions, road closures, trail conditions, weather hazards, permit requirements, business hours, safety information, and any other details relevant to your trip before and during travel, using official and authoritative sources.
The Apps are not a substitute for safe driving practices. Do not interact with the Services while operating a vehicle. Audio features are designed for hands-free listening. Pull over before using interactive features.
Significant portions of the content in the Services are generated with the assistance of artificial intelligence, including but not limited to: trip itineraries, stop descriptions, guidebook narratives, audio tour scripts, tour guide voice responses, driving time estimates, and points-of-interest information.
AI-generated content may contain inaccuracies, errors, omissions, or outdated information. This includes but is not limited to:
You must independently verify all information — especially safety-critical details such as road conditions, weather forecasts, trail closures, water crossings, and wildlife advisories — through official sources (such as the National Park Service, state DOTs, or local ranger stations) before making travel decisions.
The Services contain editorial content — including narrative audio stories, guidebook text, historical accounts, and place descriptions — that reflects the perspectives, interpretations, and opinions of our editorial team. This content is crafted for informational and entertainment purposes and does not purport to be a comprehensive, objective, or authoritative account of any subject.
Historical narratives, cultural commentary, and place descriptions may emphasize certain perspectives, simplify complex events, or reflect editorial judgment about what is interesting or significant. Editorial content represents opinion and interpretation, not established fact. We make reasonable efforts to verify factual claims, but errors and omissions may occur.
Travel Buddy provides an AI-powered voice conversation feature using Google's Gemini AI. When you use Travel Buddy, your voice audio, camera images (if you choose to send them), GPS location, and place or route information are sent to Google's Gemini AI service for real-time processing. By using Travel Buddy, you acknowledge and consent to this data sharing. See our Privacy Policy for full details.
Travel Buddy's responses are AI-generated and subject to the same accuracy limitations described above. The guide may provide incorrect information about locations, trails, history, safety conditions, or other topics. Do not rely on Travel Buddy's responses as your sole source of information for safety-critical decisions.
Some features require an account via Sign in with Apple. You are responsible for maintaining the security of your account. You may delete your account at any time from within the app, which permanently removes all associated data.
Premium features are available through auto-renewing subscriptions purchased via Apple's App Store. Subscription terms, pricing, and renewal are governed by Apple's terms and your App Store settings. You can manage or cancel subscriptions through your Apple ID settings at any time.
All content in the Services — including guidebook text, audio stories, maps, images, and generated trip materials — is owned by or licensed to Winding Way Labs LLC and is protected by copyright. You may use this content for personal, non-commercial purposes.
Content you create (such as journal entries and trip notes) remains yours. By using the Services, you grant us a limited license to store and process your content solely to provide the Services' features.

THE APPS AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT (A) THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE; (C) TRAVEL CONDITIONS DESCRIBED IN THE APPS WILL REFLECT ACTUAL CONDITIONS AT THE TIME OF YOUR TRAVEL; OR (D) THE APPS WILL MEET YOUR REQUIREMENTS.
TRAVEL INVOLVES INHERENT RISKS INCLUDING BUT NOT LIMITED TO ADVERSE WEATHER, HAZARDOUS ROAD OR TRAIL CONDITIONS, WILDLIFE ENCOUNTERS, EQUIPMENT FAILURE, AND REMOTE LOCATIONS WITH LIMITED EMERGENCY SERVICES. YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR TRAVEL AND USE THE APPS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WINDING WAY LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APPS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Winding Way Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Apps; (b) your violation of these terms; (c) travel decisions you make based on content in the Services; or (d) your violation of any third-party rights.
We may update these terms from time to time. Material changes will be communicated through the Services or on this page. Continued use of the Services after changes constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes arising from these terms or your use of the Apps shall be resolved in the state or federal courts located in California.
If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
